These terms of service are relevant to NONCOMMERCIAL projects only and are subject to revisions and edits without notice. Individual will be updated on the new terms however if the commission is in motion. These are heavily based in part from the novel "Graphic Artists Guild Handbook: Pricing & Ethical Guidelines, 13th Edition"
1.) Displayed base prices are subject to change depending on the complexity, difficulty, medium, and size of each piece.
2.) All relevant visual references must be given in order to give the final price quote.
3.) Payments must be completed in full within 7 days of the quote in order to solidify that price. Paypal is needed in order to pay, but Square is also acceptable. No other payments are accepted. Prices greater than $100 may have payment plans if need be. Once payment is made, your art will be added to the queue line here.
4.) For any piece below $100 there is allowed two revisions to the sketch phase before coloring. Any other revisions must be purchased beyond the second revision, and must be paid before I am allowed to continue on the piece.
5.) Refund policy is: If the artist hasn't started the commission yet and the commissionee wishes to cancel, the artist retains 6% of the original commission payment in USD as a convenience fee. During the sketch phase, a 50% refund will be issued. No refund is accepted past the sketch phase. If the Artist cancels the commission, 100% of the original payment will be refunded.
6.) The artist can reserve the right to cancel a commission in the issue of a refund due to poor communication, rude or inappropriate behavior, or inability to communicate in clear/effective English, or unforseen inability to complete the commission. In the event of foreign commissioners, the artist will attempt to communicate to the best of their abilities.
7.) Commission information will be communicated through email or Telegram only, as all communication will be exported regularly in order to keep accurate information backlogged.
8.) The Artist retains the right to display all commissioned work on any personal website, gallery, or journal. If the commissioned work is a time-sensitive gift the Artist may delay public showcase at the request of the Client.
9.) The Artist reserves the right to reject any commission for any reason.
10.) The Client retains all rights to their respective characters. But, this does not retain the right to the commissioned image. The Artist retains ALL rights to the commissioned work. The Client may NOT profit from the artwork beyond the resale of a physical original painting or traditional drawing. This includes the sale of the digital files or the rights to the image. Image rights may be negotiated for an added fee for the Client to create derivative works of, but must be communicated VIA Email.
11.) The Client may resize or crop the artwork to create icons, wallpapers or other graphics to be used in non-commercial digital format, but the Client cannot alter the artwork itself ater use. The Client may also upload the artwork to their own personal website or gallery acocompanied by a credit line to the Artist, and it must not be any high resolution or unwatermarked version of the artwork. The Client may create prints for personal use (display in their home or as gifts).
12.) The Artist is not responsible for lost or damaged items sent by mail.
13.) The Artist may not be available to answer emails or social media on holidays, scheduled days off work, or emergencies. If you do not recieve a reply with in 7 days, I encourage you to re-send any messages or emails. Occasionally the emails are lost in the void, or messages don't update.
14.) The Client must read, understand and agree to all above terms before entering into an agreement with the Artist. By sending payment, the Client agrees to the terms above.
In regards to Three Dimensional related works garnered by the artist, there are additional rules as stated below. This includes 3D modeling, 3D re-textures, 3D re-colors, and any digital dimensional related measures (Importing, Game object creation ETC).
